Terms and Conditions

These General Competition Terms and Conditions apply to all competitions, actions, giveaways, and prize draws (hereinafter referred to as ‘Competitions’) organized by Brasil Shorts. By entering a Competition, you agree to be bound by these General Terms and Conditions. Participation is only possible if you fully accept these terms. Please read them carefully before entering.

1. Organizer

The organizer of all Competitions is Brasil Shorts.

2. Eligibility

Competitions are open to entrants who are at least 18 years old at the time of entry, unless a specific Competition explicitly states a different minimum age. Participation is not limited to customers. Employees of Brasil Shorts, affiliated companies, advertising agencies, and their immediate family members are not eligible to participate. The organizer reserves the right to require proof of eligibility.

Participation is free of charge and not dependent on the purchase of goods or services.

3. Participation Period

Each Competition has a defined start and end date and time for entries. Entries received outside the specified participation period will not be considered.

4. Method of Entry & Required Actions

To enter a Competition, you must follow the instructions outlined in the specific Competition announcement. This may include actions such as liking a social media post, following an account, commenting, tagging friends, sharing content, subscribing to a newsletter, or filling out a form. Only entries that fulfill all specified requirements will be eligible.

Each Competition is separate. Entering one Competition does not automatically enter you into others. Unless otherwise stated, only one entry per person is allowed per Competition. Entries made using automated methods, scripts, bots, or other deceptive means are invalid and will be disqualified.

5. Prizes

The prize(s) for each Competition will be clearly described in the individual announcement (e.g., a specific product, a gift card/voucher). The prize is as described, is non-transferable, and no cash alternative or other substitution is allowed, except at the sole discretion of the organizer in the event of prize unavailability, in which case a prize of equal or greater value may be substituted.

Prizes won by minors may be awarded to a parent or legal guardian. All costs and expenses associated with prize acceptance and use not explicitly stated as part of the prize description are the sole responsibility of the winner. This includes, but is not limited to, taxes, insurance, transportation, installation, and any other incidental costs.

6. Winner Selection and Notification

Winners will be selected in a random draw from all eligible entries received, unless otherwise specified (e.g., based on the creativity of a submission). The draw will take place promptly after the closing date of the Competition.

Winners will be notified via the method used for entry (e.g., direct message on the social media platform used, email) within a reasonable timeframe after the draw. The notification will include instructions on how to claim the prize. The winner must respond within the timeframe specified in the notification to claim their prize. Failure to respond within this period may result in forfeiture of the prize, and an alternate winner may be selected.

By accepting a prize, the winner agrees to the use of their name and likeness for promotional purposes related to the Competition without additional compensation, unless prohibited by law.

7. Data Privacy

Any personal data collected during entry (such as name, email address, social media handle) will be processed solely for the purpose of administering the Competition, including winner notification and prize fulfillment. Data will be handled in accordance with the Brasil Shorts Privacy Policy. Data will not be shared with third parties for marketing purposes without explicit consent.

8. General Provisions

The organizer’s decisions regarding all matters related to the Competition (including eligibility, winner selection, and interpretation of rules) are final and binding. No correspondence will be entered into.

The organizer reserves the right to disqualify any participant who violates these General Terms and Conditions, tampers with the entry process, or engages in fraudulent or dishonest conduct.

The organizer is not responsible for: (a) lost, late, misdirected, incomplete, or illegible entries; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, network, hardware, software, or website; (c) unauthorized human intervention in any part of the entry process or the Competition; or (d) technical or human error which may occur in the administration of the Competition or the processing of entries.

If for any reason the Competition is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the organizer which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Competition, the organizer reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Competition.

To the fullest extent permitted by law, the organizer excludes all liability for any loss, damage, or personal injury suffered in connection with the Competition or the prize, except for liability which cannot be excluded by law (such as for death or personal injury arising from its negligence or for fraud).

These General Terms and Conditions are governed by Dutch law. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

This promotion is in no way sponsored, endorsed, administered by, or associated with Meta (Facebook, Instagram), TikTok, Pinterest, or any other social media platform. You are providing your information to Brasil Shorts and not to the social media platform. The information you provide will be used solely for the purposes of this Competition. You completely release the social media platform from all liability related to your participation.

10. Amendments

The organizer reserves the right to amend these General Competition Terms and Conditions at any time or to modify the rules of any specific Competition, provided such changes are communicated in a clear and transparent manner.
